Our website grants you a nonexclusive limited license to use the customized graphics, CSS and PHP code in accordance with these Conditions of Use (the “license”).

a) DEFINITIONS

Our Products – represents the copyrighted graphic images and CSS and PHP code from the product and excludes any GPL licensed original source of an “open source” script. This will refer but not limit to: all copyrighted graphics, the graphic template implementation work and solutions through CSS style sheets and PHP code. All GPL license clauses still apply to the original open source script used for implementation.

b) LIMITED USAGE GRANTED

You may only use each individual product on a single server, belonging to either you or your client. You will need to purchase a new license for multiple installations.

c) MODIFICATIONS

You are authorized to make any necessary modification(s) to our products to fit your purposes excluding the removal of our “designed by:” text from the login page which you are not permitted or authorized to remove without prior consent.

d) UNAUTHORIZED USE

You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent.

e) ASSIGNABILITY

You may sub-license, assign, or transfer this license to anyone else with prior written consent from ensigniamail.com. This is because we will need to change the information of the license key to the new user.

f) ANONYMOUS STATISTICS

The Products gathers anonymous usage information for statistical analyses. The recorded statistics include the device type used to check the mail (smartphone / tablet / desktop) and the skin used. This information helps us to properly channel our efforts in developing the future versions of the software. The information is completely anonymous, we do not record any personal information.

g) OWNERSHIP

You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified.

h) WARRANTY

Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall we be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

i) REFUND POLICY

Since our products are non-tangable digital goods and there is no way return the product, we do not issue refunds after the product is downloaded. Only under certain circumstances when or if the product does not work and we have concluded that there is nothing we are able to do to fix the issue only then will we grant a refund.

j) ANTI-FRAUD

Because there is so much fraud on the internet, especially with fake credit card payments, we often manually check orders. If they are found to be suspicious or deemed to be fraudulent we reserve the right to cancel or suspend such orders without notice. We will also notify the authorities by sending them all the information available.
